Quality healthcare remains one of the main aspirations of Brazilian citizens. Three decades after the promulgation of the Constitution, the numerous obstacles that still exist give such aspirations tones of concern for people and challenge for institutions.
The institutional challenge of organizing the Brazilian Health System and offering, at the right time and in the appropriate way, the services that the population needs was a mission assumed, throughout the 20th century, by the Legislative Power and, especially, by the Executive Power. Various initiatives shaped national health actions and services, culminating, in 1988, in the consecration in the constitutional text of the right to health, of a universal and egalitarian nature. The formatting of social rights in these molds would soon invite the Judiciary to share the responsibility of transforming into reality the constitutional plan that provides for the right to access to health for each Brazilian, but also the instrument for its realization: the Unified Health System (SUS).
The interface between law and health gained notoriety, from the 2000s onwards, with the sharp growth of lawsuits for access to health, whether within the SUS or in the area of supplementary health. The Judicialization of Health, an expression that gained traction in the last decade, stimulated debate between institutions with the mission of providing Health and the Justice System. More than that, it made imperative the task, the responsibility of all these actors, to build and organize new institutional arrangements for the development of the Health System.
It is from this perspective that we propose to discuss, once again on Espírito Santo soil, the directions of the Health system – public and supplementary, and the performance of the Judiciary in resolving conflicts. This annual, already consecrated meeting, now in its 9th edition, the BRAZILIAN MEDICAL AND LEGAL HEALTH CONGRESS, will feature the participation of acclaimed professionals, both from the Health System and the Justice System, who will examine current topics, always seeking to improve the Unified Health System, an achievement of the Brazilian people.
We count on everyone's participation, so that we can advance good practices in the area of Health, a desire of the entire Brazilian population, which aims to live in a truly citizen society.
